Fundraising

• WHERE TO BUY RAFFLE TICKETS.
  Raffle tickets may be purchased from the following locations:  Syds in Tahoe City, Thin Air Motor sports Truckee, Bridgetender, Tahoe Community Nursery School, and from any TCNS Parent.  Raffle ticket Sales at these locations will continue till all tickets are sold out or utill 01/17/10 whichever comes first.  On 01/17/10 raffle tickets can be purchased at Syds Bagelry unitl the raffle at 8pm.  TCNS reserves the right, at its sole discretion, to sell tickets at other locations and add other participating retail locations.  Total number of tickets sold will be a maximum of 2000 tickets.  NO PURCHASE NECESSARY: To receive one (1) raffle ticket without purchase, send a self-addressed, stamped envelope postmarked between 10/15/09 and 11/15/09, and received by 11/15/09 to "Free Ticket Request from Tahoe Community Nursery School", P.O. Box 1265, Tahoe City, CA 96145-1265.
• HOW DOES THE PROMOTION WORK.
  Make a donation to Tahoe Community Nursery School and in return receive a raffle ticket for the chance to win a SkiDoo 2010 snowmobile.  Suggested donation is $20.00. Each raffle ticket entered will have a chance to win a SkiDoo 2010 snowmobile donated at dealer cost by Thin Air Motor Sports in Truckee, Ca. Only one chance to win per raffle ticket.  One (1) snowmobile Grand Prize will be awarded on January 17, 2010.  Several "other" prizes collected by volunteers will be available to win (example:  Ski resort lift tickets, restaurant gift certificates and gift certificates from local retail stores. )
  
• RAFFLE DRAWINGS.
  Entries in the Raffle will be randomly selected on January 17th, 2010 at Syds Bagelry in Tahoe City at or around 8 p.m.  The Grand Prize winner (1) for the snowmobile will be randomly selected first then we will continue to draw names for other prizes that we have and are listed on the website. Drawings will be conducted randomly and in front of all present.  The winner drawn on that day by the person doing the drawing will be final and binding. All entries drawn are subject to verification. Entries that are incomplete or non-compliant with these rules will be void.  
  
• PRIZE.
  1. Snowmobile Prize: Snowmobile Prize winner will receive a 2010 SkiDoo Summit Everest 800R 154.  Total estimated retail value is $10,599.00 dollars. Winner is solely responsible for all applicable taxes (including, without limitation, sales tax and income tax), insurance costs, surcharges, registration, title, and license fees and other costs incurred in claiming, registering or using the snowmobile. Snowmobile includes standard features; any additional options are winner's responsibility. Winner will be required to personally retrieve the snomobile from a local dealership or location, as determined by TCNS, and may need to provide valid driver's license and proof of insurance/registration. Failure to accept possession of snowmobile within thirty (30) days of notification of availability may result in prize forfeiture.
     

No substitution of prize is offered, no transfer of prize to a third party permitted, and non-cash prizes may not be redeemed for cash value, except as stated herein or as determined by TCNS in its sole discretion. TCNS shall have no obligation to award any unclaimed prizes.

5. Snowmobile PRIZE WINNER NOTIFICATION.
   Snowmobile prize winner will be notified by overnight mail at the postal street address provided at the time of donation.  Any winner notification returned as undeliverable without a forwarding address may result in snowmobile Prize forfeiture and an alternate winner may be selected at TCNS discretion. Snowmobile Prize winner will be required to sign and return an Affidavit of Eligibility and Liability Release with (where lawful) a publicity release ("Affidavit") within ten (10) days of attempted winner notification (as indicated by the date referenced in the Affidavit). Failure to return the Affidavit within ten (10) days may result in snowmobile Prize forfeiture, and an alternate winner may be selected. If mail is returned as undeliverable without a forwarding address, then snowmobile Prize may be forfeited. Unless otherwise noted, allow 8-10 weeks for snowmobile Prize information by mail following completion of notification process. Snowmobile Prizes will only be awarded and delivered to valid names and addresses within the United States. Any snowmobile Prize won by a minor may be awarded to the minor's parent or legal guardian, and if applicable, any Affidavit relating to a snowmobile Prize won by a minor must be executed by the minor's parent or legal guardian. Any portion of a snowmobile Prize not accepted by a winner will be forfeited.
   
6. ELIGIBILITY.
   Raffle open only to legal United States residents residing within the fifty (50) United States or District of Columbia throughout the Promotion Period. Void elsewhere and where prohibited by law.
   
7. LIMITATIONS OF LIABILITY.
   No responsibility or liability is assumed by TCNS and its Administrators for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Web Site; unauthorized human or non-human intervention of the operation of the raffle.  TCNS and its Administrators are not responsible for any typographical or printing errors in the raffle tickets, any display or announcement of prize winner on the Web Site, Raffle prizes or these Official Rules, or any inaccurate or incorrect data contained on the Web Site, including without limitation, the number of entries entered in any particular drawing.  WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE WEB SITE IS PROVIDED "AS IS" WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. TCNS and its Administrators make no representations or warranties of any kind concerning the appearance, safety or performance of any prize. Winner bears all risk of loss or damage to prize after delivery/acceptance. All participants and/or winners, on behalf of themselves, their executors, heirs and assigns, by acceptance of any offer/prize received under this raffle, agree to release TCNS and its Administrators from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses of any kind to persons or property which may be sustained in connection with the conduct, promotion or outcome of the raffle, receipt, ownership or use of any such prize or while preparing for, participating in or traveling to and/or from any prize-related activity in connection with the raffle or otherwise. Under no circumstances will TCNS and its Administrators be liable for punitive, incidental, consequential, or any other damages.
   
8. PROMOTION MODIFICATION.
   Tahoe Community Nursery School, (TCNS) reserves the right, at its sole discretion, to modify, cancel, suspend and/or terminate this raffle in whole or in part at any time during the Raffle Selling Period for any reason whatsoever, including without limitation, in the event that the fundraiser/raffle is not capable of running as planned or as intended by these Official Rules. In the event of raffle cancellation, all entries will be deemed expired and void and all monies collected will be returned. TCNS shall have no further liability with respect thereto.
   
   TCNS may modify and amend these Official Rules as they appear online from time to time during the raffle selling period for clarification purposes without materially affecting the terms and conditions of the fundraising raffle. TCNS is not responsible for any typographical errors in the advertising of any prize included in the Raffle or the Official Rules, Web Site pages or other promotional materials.
   
   
   
9. CONDITIONS OF PARTICIPATION.
   All participants agree to be bound by these Official Rules and the decisions of TCNS and its Administrators whose decisions in all aspects of this Raffle shall be final and binding. This Fundraising Raffle is governed by laws of the State of California and all Raffle participants hereby submit to the jurisdiction and venue of Tahoe City, California for resolution of all claims and disputes. TCNS good intentions is to sell raffle tickets to raise funds for its non-profit 45 year old community school thereby continuing its long tradition of servicing the children of North Lake Tahoe and to be honorable in raising funds anyone trying to be fraudulent, potentially fraudulent can at TCNS sole discretion be in violation of these Rules or generally inconsistent with the intended operation of the raffle.  
   
10. PUBLICITY CONSENT/WINNER'S LIST.
    Publicity Consent:
    Raffle Winners must grant to TCNS the unconditional and irrevocable right, without any further compensation, consideration, notice, review or consent, to use exhibit and publish, in any medium now known or hereinafter known at any time throughout the world their name, address, image, likeness, voice, biographical information and statement for advertising, publicity, trade and public relations purposes, to the extent permitted by law; and Raffle snowmobile Winner may be required to confirm such consent in writing by executing appropriate Affidavit required by Sponsor, as described in Rule 8.
